Effective Date: May 28, 2026  |  Last Updated: May 2026

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the Elevate Solutions website at elevatesolutions.io (the "Site"), operated by Elevate Solutions ("Elevate," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. About These Terms and Client Agreements

These Terms govern your use of the Site only. They do not supersede or modify any separately executed client agreement, such as a Master Services Agreement, Statement of Work, or Service Level Agreement. Where a client agreement is in place, that agreement governs the services provided to that client.

3. Use of the Site

You agree to use the Site only for lawful purposes. You will not:

  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems.
  • Use the Site to transmit malware, spam, or other harmful or unlawful content.
  • Interfere with or disrupt the operation, integrity, or security of the Site.
  • Misrepresent your identity or affiliation when using the Site or contacting us.

4. Intellectual Property

All content on the Site — including text, graphics, logos, images, software, interactive tools, and the underlying design — is owned by Elevate or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and use the Site for your own informational and business evaluation purposes. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent. "Elevate Solutions," our logo, and related marks are our trademarks.

5. Interactive Tools and Content

The calculators, assessments, and other interactive tools on the Site, along with articles, guides, and reports we publish, are provided for general informational purposes only. Their output is an estimate, not professional IT, security, legal, or compliance advice, and should not be relied upon as such. Always consult a qualified professional before making decisions based on this content.

6. Information You Submit

Information you submit through forms on the Site — including contact, consultation, assessment, subscription, and resource-download forms — is handled as described in our Privacy Policy. You represent that the information you provide is accurate and that you are authorized to provide it.

7. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Elevate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless Elevate and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of any third-party right.

10. Third-Party Links

The Site may contain links to websites and services we do not operate. We are not responsible for their content, practices, or terms, and a link does not imply endorsement.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction and venue of those courts.

12. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.

13. Changes to These Terms

We may update these Terms from time to time. Material changes take effect 60 days after we post the updated Terms to the Site, unless a shorter period is required by law. Your continued use of the Site after the changes take effect constitutes acceptance of the updated Terms.
